Purchase and Sale of Residential Property

Buying or selling your home or investment property is one of the biggest decisions that you will make, don’t consider doing it without obtaining the right legal advice. At Kevin Hockey & Associates all of the legal work is carried out by a solicitor, not by a clerk, and your interview to go through the contract will be with Mr Hockey.

If you are considering purchasing at auction there are some special requirements that you should be aware of, and these things should be discussed with your solicitor before you bid on the property. At Kevin Hockey & Associates we don’t charge you to go through the contract prior to the auction, if you are not the successful purchaser there is no fee.

If you are selling your property it is important that the contract is prepared in accordance with your instructions, and includes the items that are to stay with the property.

You don’t need to pay a fortune for your conveyancing service. At Kevin Hockey & Associates we have a set fee for all of our residential sale or purchase matters, no matter the price of the property. Speak to one of our friendly staff for more information.

First Home Buyers

Whilst buying any house can be stressful, purchasing your first home can be a very exciting but uncertain time. It is important to get professional advice from someone who understands your situation and can assist you to make the right decisions.

At Kevin Hockey & Associates we pride ourselves in assisting first home buyers, from advising you about the contract, the need for appropriate reports, finance requirements, First Home Owners Grant and Stamp Duty exemptions, to your insurance and settlement needs.

Our set fees for residential properties apply, and you don’t pay anything until settlement. Our fees can come out of the funds that you borrow for the house. Speak to us about how we can assist you to get into your first home.

Purchase of Sale of Business or Leasing

Buying or selling of a business, or leasing of premises for business purposes is a specialised area of law, and an area that you need to receive the proper advice, and you need it in a hurry.

Often once the decision to buy sell or lease has been made in business, you need to be able to see your solicitor and get things moving immediately. At Kevin Hockey & Associates we will make an appointment for you to see a solicitor, if possible the same day, and have the contracts prepared without delay. That way you can get on with business with as little interruption as possible.

Wills, Powers of Attorney and Guardianship

It is important to know that you have your affairs in order. None of us can control what happens in life, but we can take steps to see that our family is protected and our wishes enforced in the event of death or injury.

At Kevin Hockey & Associates we don’t just do wills, we do what we call an estate package. We will discuss with you not just your needs as far as making a will is concerned, but also your superannuation and insurance requirements, as well as considering the needs for Powers of Attorney and Guardianship documents, and whether these should be standard or enduring documents.

Again we have set fees for these services, so contact us, it is well worth it to know that your affairs are in order should the worst occur.

Police Charge matters/Drink Driving/AVOS's etc.

Mr Hockey is an ex police prosecutor with over 13 years in the NSW Police Force. Mr Hockey retired from the police in 1998 at the rank of Sergeant, and was then the Senior Police Prosecutor in charge of the Dubbo and Orana Region.

We can all make mistakes that bring us in conflict with the law, but it is important to be well represented at court if these things occur to ensure the best possible outcome in the circumstances.

Give Mr Hockey a ring if we can be of assistance in any of these areas.

Deceased Estates

The loss of a loved one and the legal and financial implications of that loss can be overwhelming.  It is imperative at the time of the loss that you receive immediate legal advice in regard to your rights and obligations as an executor of an Estate - or as a beneficiary or potential beneficiary to the assets of a deceased person.

Mr Hockey runs a sound Estate practice in conjunction with Louise O’Halloran who has many years administrative and practical experience in this area of law.

Both Mr Hockey and Ms O’Halloran will assist you in meeting your obligations and advising and assisting you in administering the Estate and if necessary applying to the Supreme Court of New South Wales for a Grant of Probate to prove the deceased’s Will or an Application for Letters of Administration if the deceased did not leave a Will.  These are documents that, dependent upon the size of the Estate and the way in which assets are held, may be required before you can sell, transfer, convert, call in and distribute a deceased person’s assets in accordance with the deceased’s Will  or in accordance with the rules of intestacy as the case may be.

Mr Hockey can assist you in making a claim against the Estate of a deceased person if you have been excluded from a Will or if you are of the opinion that you have been left unduly disadvantaged in any bequest made to you in a Will.

We can also assist you in defending any claim made against an Estate for which you are an Executor.

Mr Hockey and Ms O’Halloran are conscious that suddenly being faced with the legalities of dealing with the assets and debts of someone you love can be a difficult and emotional experience.  You can be assured that the carriage of your Estate matter will be treated with the utmost respect and care.
